A. About these terms.
These terms apply to your use of the Donwood Foot and Orthotic Clinic website, the website chat assistant, and the automated after-hours telephone line (together, the "Digital Services"). By using the Digital Services you agree to these terms. If you do not agree, please contact the clinic directly at (416) 445‑1414 instead.
B. What the Digital Services do and don't.
The Digital Services provide general clinic information (such as hours, services, and directions) and help you request an appointment time or book online. The chat assistant and the after-hours line are automated and are not staffed by a health professional. They do not provide medical advice, diagnosis, treatment, or triage, and using them does not create a patient relationship or any professional relationship. Always rely on a qualified health professional for medical advice, and on the clinic's staff to confirm any appointment.
C. Emergencies.
The Digital Services are not for emergencies and are not monitored in real time by clinic staff. If you have a medical emergency: for example uncontrolled bleeding, a cold, blue, or numb foot, a spreading infection with fever, or symptoms such as chest pain call 9‑1‑1 or go to the nearest emergency department immediately. If you have an open wound, a sore that is not healing, a sudden change in colour, or a problem that is getting worse quickly, seek same-day medical care do not wait for the clinic to open.
D. Requests and holds are not confirmed appointments.
A time you discuss or"hold" through the Digital Services is a request only. An appointment is booked only when confirmed by the clinic or through the clinic's own online booking system. The clinic is not responsible for a time you believe was held until it is confirmed.
E. Automated interaction, recording, and accuracy.
The chat assistant and after-hours line are automated systems that use speech and language technology. Conversations and calls are recorded and stored, and are shared with the clinic's reception team so they can follow up. Automated systems may make mistakes: including mishearing or mis-recording a name, number, email, or
requested time - so please review anything important and confirm it with the clinic. If you send a booking-link text message, it may arrive from a different number than the one you called, and standard message/data rates may apply.
F. No warranties; limitation of liability.
The Digital Services are provided on an "as is" and "as available" basis, without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, neither Donwood Foot and Orthotic Clinic nor its third-party service providers who operate the Digital Services on the clinic's behalf (including its automated answering and chat provider) will be liable for any indirect, incidental, or consequential loss, or for any loss arising from the accuracy, availability, or use of the Digital Services or from reliance on any automated response. These service providers are intended third-party beneficiaries of this Section F and of Sections B–E and may rely on them. Nothing in these terms limits liability that cannot be limited by law, and nothing here affects your rights to receive care from the clinic.
G. Privacy.
Your personal and health information is handled in accordance with our [Privacy Notice](/privacy) and Ontario's Personal Health Information Protection Act, 2004. The clinic is the custodian of your health information; requests to access or correct it are handled by the clinic.
H. Governing law.
These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.
